Terms and Conditions
These terms govern the use of this website, the booking of tourism experiences and the relationship between Beyond Colombia and travelers.
Draft pending legal review. This text has not yet been approved by Colombian counsel. Fields marked [PENDING] are waiting on information from Beyond Colombia.
1. Identity and scope
This website and booking platform are operated by [PENDING: FULL LEGAL NAME], Tax ID [PENDING: NIT], National Tourism Registry [PENDING: RNT] (“Beyond Colombia”). These terms govern website access, tourism bookings and the relationship with travelers.
Each experience page and booking confirmation will identify whether Beyond Colombia directly provides the service or acts as an intermediary for an identified operator or guide. Nothing in these terms limits mandatory consumer rights under Colombian law.
2. Acceptance and electronic contracting
By completing a booking, the traveler confirms that they have read and accepted these terms, the experience-specific cancellation policy and the Privacy Policy. Electronic contracts and communications are valid under Colombian law.
An automated order acknowledgement does not guarantee availability. The contract is confirmed when Beyond Colombia issues the booking confirmation or voucher and, where applicable, payment is authorized.
3. Experience information
Before booking, travelers must review the destination, date, time, duration, language, participants, selected option, meeting point, inclusions, exclusions, requirements, accessibility, price and cancellation policy.
Availability, time, language, capacity, resources and price are revalidated at confirmation. Obvious price or availability errors will be reported before confirmation and will not result in an unauthorized charge.
4. Prices, payments and promotions
Prices are displayed in [PENDING: MAIN CURRENCY] and all included or additional taxes, fees and charges will be disclosed before checkout. Payments may be processed by authorized third parties under their security controls.
Promotional codes are subject to their announced validity, availability and conditions and may not be combined unless expressly stated.
Tips-based tours
A “Free Tour” or “tips-based tour” has no fixed prepaid participation fee unless the product page discloses a booking fee or paid add-on. Tips are voluntary and determined by the traveler. Additional options may carry a price.
5. Voucher and booking details
The traveler will receive a voucher showing the booking number, experience, date, time, language, participants and meeting point. Errors must be reported promptly through [PENDING: SUPPORT CHANNEL].
The voucher may be required at check-in and may not be resold or altered.
6. Traveler-requested changes
Changes must be requested through [PENDING: CHANNEL] within the period stated on the experience page. Rescheduling is subject to availability, capacity, language, time, price differences and the experience’s operational cutoff.
The policy displayed before payment and stored in the confirmation forms part of the contract, without limiting statutory rights.
7. Cancellations and no-shows
Each experience must clearly state its free-cancellation deadline, refund percentage after that deadline, any lawful non-refundable cost, no-show rules and refund procedure.
No-show consequences apply only when clearly disclosed and accepted, and only within legal limits. Under Article 65 of Law 300 of 1996, the applicable agreement may permit a 20% charge or retention of a previously received deposit or advance—not both automatically.
There is no monetary refund for an unpaid booking, although the reserved place may be released.
8. Changes or cancellation by the provider
For safety, weather, closure, public-order, force-majeure, minimum-capacity or reasonable operational reasons, the guide, route, time or meeting point may change. Material changes will be communicated promptly.
If the contracted service cannot be delivered, the traveler may choose, as legally applicable, an equivalent service, penalty-free rescheduling, or reimbursement or compensation, consistent with Article 63 of Law 300 of 1996.
9. Right of withdrawal
Where the statutory right of withdrawal applies to a distance sale of services, the consumer may exercise it within five (5) business days after contracting under Article 47 of Law 1480 of 2011.
Its application depends on the statutory requirements and exceptions, including the nature and start date of the service. Requests must be sent through [PENDING: PQR CHANNEL]; lawful refunds will be made without improper deductions and within the applicable statutory period.
10. Payment reversal
For fraud, an unauthorized transaction, non-receipt, non-conforming service or another statutory event, the consumer may request reversal of an electronic payment under Article 51 of Law 1480 of 2011.
The consumer must submit the complaint to Beyond Colombia and notify the payment-instrument issuer within five (5) business days of the applicable event. Beyond Colombia will cooperate with the processor and financial institutions.
11. Operators and third parties
Some experiences may be delivered by identified independent guides or third-party operators. The product page and confirmation will identify the service provider and any specific conditions.
Third-party involvement does not remove responsibilities legally attributable to Beyond Colombia. Third-party terms apply only when clearly disclosed before contracting and consistent with mandatory law.
12. Safety, risk and force majeure
Experiences may involve walking, weather, traffic, uneven terrain and other ordinary risks disclosed on the product page. Travelers must assess their ability and follow safety instructions.
Beyond Colombia is not responsible for events exclusively attributable to the traveler, unrelated third parties or force majeure, except where the law provides otherwise. These terms do not exclude liability for intent, negligence, service failure or liability that cannot lawfully be limited.
A guide may deny or stop participation for objective safety reasons, violent conduct, harassment, intoxication, serious refusal to follow instructions or risk to the group, without arbitrary discrimination.
13. Traveler duties
Travelers must provide accurate information, arrive on time, carry required documents, disclose relevant health or mobility needs, follow instructions, supervise minors, respect communities and heritage, protect personal belongings and avoid conduct that jeopardizes safety.
14. Minors and accessibility
A parent or authorized guardian must book for minors and satisfy the requirements disclosed for the experience. Identification, proof of relationship or authorization may be requested.
Accessibility needs should be communicated before booking. Beyond Colombia will provide reasonable information and available alternatives but cannot guarantee technically unavailable adaptations.
15. Personal data and communications
Personal data is processed under the Privacy Policy [PENDING: URL], Colombian Law 1581 of 2012 and applicable regulations. Necessary information may be shared with operators, guides, booking platforms, payment processors and technology providers for the booking and authorized purposes.
Marketing communications require the applicable authorization and may be withdrawn through the Privacy Policy channels.
16. Intellectual property
Text, trademarks, photographs, video, design, itineraries and other content belong to Beyond Colombia or its licensors. Personal, non-commercial use is permitted. Reproduction, automated extraction, resale, modification or commercial use requires written authorization.
Identifiable traveler imagery may be used only under a valid authorization or lawful basis.
17. Complaints and consumer protection
Requests, complaints, withdrawal and payment-reversal claims may be submitted through [PENDING: PQR CHANNEL], [PENDING: ADDRESS] or [PENDING: PHONE]. Beyond Colombia will acknowledge and answer within the legally applicable period.
Consumers may contact Colombia’s consumer authority after any required direct claim: [Superintendence of Industry and Commerce](https://sedeelectronica.sic.gov.co/temas/proteccion-al-consumidor/derechos-y-deberes/denuncias-y-demandas).
18. Tourism registration and child protection
[PENDING: LEGAL NAME] operates under National Tourism Registry [PENDING: CURRENT RNT], subject to legal verification and renewal.
ESCNNA warning: Under Article 17 of Law 679 of 2001, Beyond Colombia warns travelers that the sexual exploitation and abuse of children and adolescents are criminally and administratively punishable in Colombia. Beyond Colombia rejects and reports conduct facilitating commercial sexual exploitation in travel and tourism.
19. Governing law, language and amendments
These terms are governed by Colombian law. Consumers do not waive any court, authority or protection legally available to them.
The Spanish and English texts are intended to have equivalent meaning. For transactions governed by Colombian law, the Spanish version prevails without reducing consumer rights.
Future amendments apply to new bookings from publication. The version accepted at checkout remains associated with the order. If one provision is invalid, the remaining provisions continue in force.
